    Is it a scam or a rip-off?

    It can sometimes be difficult to tell the difference between a scam and a dubious offer.

    If you've been misled by an offer, you have rights which providers cant breach.

    For something to be considered an offence under the Fraud Act, the perpetrator must intend to steal from their victim or have intent to perpetrate a fraud.

    For example, if you pay for a service that doesn't exist because the provider is running a fake company, this is a scam and is definitely considered to be fraudulent activity.

    How to spot a SCAM :

    Firstly go to the link provided HERE and then read on.

    Deliberately misleading

    However, if the provider is not intending to steal but is deliberately misleading you or is grossly negligent, they could be in breach of contract.

    Although this isn't considered to be a scam (or fraudulent activity) it's still considered to be questionable practice.

    The Consumer Rights Act (which replaced the Sale of Goods Act on 1 October 2015) stipulates that goods sold must be as described, of satisfactory quality and fit for purpose.

    Fit for purpose means that products must be fit for both their everyday purpose and also any specific purpose you agreed with the seller.

    If these criteria are not met, then the seller could be in breach of the Consumer Rights Act.

    As the years pass by we are targeted by crooks and scammers and the assault that is going on nowadays is virtually constant.

    We have to keep our wits about us and be VERY careful what we do on the internet or via E-mails.

    That's a very interesting bit of information Papa.

    I did not really know that they were so different in types of fraud.

    Yes, that is the greatest problem with the scammers and the rip-off merchants Angie.

    The techniques they use to get to us are fast becoming better and more dangerous than they used to be.

    I think that the best guide against these type of attacks is to firstly recognise that they seem too good to be true, and anything like that usually is.

    Maybe it's strange, but that has been my maxim for life all of my adult years.

    We still need to be on our guard and never take anything like that for granted.

    Rather than "cynics" I would call the present population more choosy than they have ever been before.

    This does not stop the scammers and the fraudsters getting through our defences though.

    Mind you, if you think that "cynics" is too strong a word it is often a way to protect by instinct.

    I think I will remain a cynic.
