    Employment tribunal fees unlawful.

Post by papa_umau on Wed 26 Jul 2017, 10:59 am

Employment tribunal fees unlawful, Supreme Court rules.

Fees for those bringing employment tribunal claims have been ruled unlawful, and the government will now have to repay up to 32m to claimants.

The government introduced fees in 2013 to reduce the number of malicious and weak cases, but that led to a 79% reduction over three years.

Trade union Unison argued that the fees prevented workers getting access to justice.

The Supreme Court also found fees were indirectly discriminatory to women.

It ruled the government was acting unlawfully and unconstitutionally when it introduced the fees.

Well folks, there you have it; confirmation that this and previous Tory governments do all they can to attack the rights of the workers.

As if you didn't already know this of course.

Even as an employer I can see that these charges are not on.

Everybody in Britain should have free access to the law and not just the well-off ones.

Let's hope that this change, done by the Tories, is scrapped for ordinary people.

Even if a means test might need to be done then that would be alright by me.

This subject was actually on the national BBC news last night.

Many of the unions are now calling for these fees to be dropped for access to the law by ordinary people.

The Legal Aid system was designed to do this, but it has always been flawed and it just not do the job it was intended to do.

Just removing these charges by law would be the best way to make the changes that are needed here.

I'm glad they have been scrapped, although Ministers have implied that they will find a way around it.

Yes, HG, again, you are right.

Mind you if they wanted to fix this great gap in access to law for the poor they could do it properly by making the Legal Aid System much more effective, by modernising it.

Yes, at one time it was totally free to anyone in need; but 25 years ago approximately, fees were introduced for certain things, such as battered spouses seeking to divorce their abusers.

They, the Tory government, seem to think that everybody can find the money to pay for access to law when in truth, the only people that can are the rich.
