    Unmarried woman wins pension battle.

Post by papa_umau on Wed 08 Feb 2017, 10:55 am

A woman who lost her long-term partner has won a legal battle that is likely to improve the pension rights of unmarried couples in the public sector.

Denise Brewster, who was denied payments from her late partner's occupational pension, argued that she was the victim of "serious discrimination".

Following a to and fro legal fight, she won her case at the UK's highest court.

The case was closely watched by pension schemes which could change their rules.

OK, I know you are going to say that she should have got married in order to guarantee these payments, but there are now many thousands of couples that are happy living together and making commitments to each other without getting married.

Do you think that this change is a good thing or not ?

This could have a strong effect on pension schemes if bidey-ins now have a claim on their unmarried partners pension rights.

Not necessarily a bad thing I would say.

I have always thought it strange that the 'official' piece of paper was needed, especially after couples have devoted their lives to each other. That being said, there is the possibility of fraud.

While that is true, there is no reason why a civil partnership could not be arranged as these partnerships are accepted by law.

Agreed, yet there are couples who don't feel comfortable even with those; many Muslim couples are not legally married under the eyes of the British Law, for instance.

For precisely that reason I think that the institution of marriage is now dwindling away and might eventually be overtaken by civil partnerships in many countries of the world.

Funny you should mention it, but my partner and I are living in a full civil partnership and nothing different would make us any happier.

As our friend HG said, it is all about how "comfortable" the couple feel inside or outside the bonds of marriage.

The laws are already changing fast to take into account what the young people need and want in this respect.
